Contested Probate

One of the more unfortunate kind of disputes which arise from time to time concern disputes over the will of a deceased persom. This can involve arguments over a person's entitlement to be a beneficiary under a will, particularly where there are questions over the deceased's testamentary capacity or where undue influence may have been exercised over them by a relative. We offer a full service with regard to such disputes. We are also regularly asked to act for members of the family or dependants of someone who has died where no provision was made in a will and this can result in our making a claim under the Inheritance (provision for Family Dependants) Act 1975 which permits an individual to make a claim to Court for a share in the Estate.

We also deal with applications relating to an enduring Power of Attorney, for an example to have an Attorney removed and also applications to the Court of Protection where mental capacity is in issue. We can also advise in situations where there has been negligent drafting of a will and also questions as to the validity of a will.

We are normally able to offer a fixed rate initial interview in order to assess a client's claim. We advise throughout Hampshire, West Sussex and beyond. In the first instance, please contact Patrick Jenkins at our Petersfield office.

As well as providing a full legal service during office hours we are now able to offer free of charge 20 minute meetings by appointment only. These will take place between the hours of 5.30 and 7pm on a fortnightly basis on matters relating to disputes and litigation only. During these sessions we will give preliminary advice only but we hope to be able to provide assistance particularly to those who are in the first instance unable to meet with us during the day.
