Divorce

All solicitors in our large family law team are members of Resolution (previously known as the Solicitors' Family Law Association) and are committed to resolving all family law disputes in a manner that limits confrontation, wherever possible. We are conscious that parties contemplating divorce, or in the process of divorce proceedings, often experience considerable difficulty and stress. As such, clear and sensitive advice and support is required.

We can advise you whether you are simply contemplating divorce and want to find out what is involved or if you have just started divorce proceedings and wish to know what you should do next. There may be circumstances when a separation agreement or judicial separation is more appropriate to your circumstances than divorce proceedings.

We will provide you with advice on the financial repercussions of a divorce and, in particular, how assets within a marriage will be divided upon divorce. Where appropriate, we will always aim to negotiate a suitable financial settlement in order to avoid unnecessary acrimony and to limit legal costs for both parties. However, this is not always possible and, for instance, where one party will not co-operate by providing documents to prove their financial circumstances, or is taking an unrealistic position in terms of the level of an appropriate division of finanical assets, it is often prudent to commence Court proceedings to avoid further delay.

We have particular expertise in cases involving substantial assets and, in particular, cases with complex pension, businesstax and trust issues or with an international dimension. Our Head of Department, Deborah Taylor, has particular specialism in this area.
