Dispute Resolution

We will advise you and act for you in relation to any dispute whether over contractual/consumer claims, arguments over land, a will or a trust or tenancy disputes where we will act for both landlords and tenants. Our first aim is to resolve the dispute for you as quickly and cost effectively as possible and with the best outcome but, where necessary, we will vigorously pursue claims to Court on your behalf. We also will advise on referring a dispute to formal mediation where the other party agrees and where appropriate.

Common examples of disputes which arise are:-

  • Building Disputes

We have considerable experience in acting for clients who have disputes with their builder. These are always difficult cases for the client as they frequently involve emotional upset and disruption to the client affecting their own homes. We will always act effectively but sensitively to achieve the best outcome for the client.

  • Contract/consumer credit disputes

We are frequently called to act in all points of contractual claims and all aspects of consumer credit law including breach of guarantee and warranty, unfair contract terms, agency disputes and distance selling regulations.

  • Boundary problems and land disputes

We regularly advise clients on all aspects of disputes concerning land, including boundary disputes, rights of way and rights of light actions, restrictive covenants, adverse possession claims, actions under the Trusts of Land and Appointment of Trustees Act 1996 involving the ownership of land and enforcement of Orders on behalf of Trustees, and Party Wall disputes. We also act in cases requiring the removal of trespassers or squatters, both in residential and commercial properties. We also advise and where necessary obtain injunctions under the Protection from Harassment Act. 

  • Landlord and Tenant Disputes

We act for private landlords who wish to bring a tenancy to an end or who have other claims against the tenants and take proceedings to recover possession of premises, both commercial and residential. We also act for tenants in disputes with their landlords.
